PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY.

You agree to be governed by the following Terms of Service by accessing and using the "GoMyWay Canada" platform (hereinafter referred to as "GoMyWay Canada," "we," "us," or "our"). These conditions include important details regarding your legal rights, options, and responsibilities, as well as some exclusions and limits. Before using our Services, you must carefully read and comprehend our Terms of Service. Whether or not you register, using the Service indicates your agreement to these Terms of Service. You are not permitted to access or use the Service or any of our content if you disagree with these terms. Penalties for breaking these terms of service might be both civil and criminal.

Definitions and Applicability:

All services offered by GoMyWay Canada, a business registered in the Canada, are subject to these Terms of Service. GoMyWay Canada runs a website (gomyway.ca) that links people looking for transportation for the same journey with drivers who have vacant seats in their cars. The services can be accessed via our website, www.Gomyway.ca, as well as any additional subdomains or mobile applications made available by GoMyWay Canada.

Typical Definitions

"Member":   A user of the Service, who may be a registered driver, passenger, or another person.
"Driver" :   A user who offers extra seats in their car for use by other passengers going in the same direction.
"Passenger" :  Refers to a user who reserves a seat in a driver's car.
"Account" :  A Member's personal login for the GoMyWay Canada website.
"Trip" :  A trip is a specified route between an origin and a destination, including information on pick-up and drop-off locations, seating options, and luggage capacity. Drivers plan and coordinate trips.
"Booking" :  The process of making a Contribution (described below) to reserve a Trip through the Service prior to the Trip's departure.
"Request" :  A passenger's posted request for a trip between two specific places on a given date.
"Contribution ":  The sum paid by the passenger to the driver to defray the expenses of a particular Trip; the driver does not receive a profit.
"Booking Fee ":  A service charge that is paid by the traveller when they book a trip and is added to the Contribution.
"Payment" :  The sum paid by a traveller while making a reservation for a trip (contribution plus booking fee).
"Payout" :  Amounts received by the driver via their selected Payout Method from bookings made on a trip.
"Payout Method":  Usually, bank transfers are utilised to send a Payout to a driver.
"Cancellation Allowance":  UEvery six months, drivers are only permitted to cancel a maximum of one Trip with authorised passengers or one authorised Booking.
"Taking a ride," "Rideshare," "Ridesharing," or "Carpooling":  Describes the act of splitting a trip in a car with another person in exchange for a contribution.

The Terms of Service have changed:

GoMyWay Canada retains the right to alter the Service or these Terms of Service at any time without prior notice, including the Booking Fee. The "Last Updated" date will be updated when any changes are uploaded on the website or made available through the mobile application. You consent to be bound by the revised Terms of Service by using the Service after such revisions have been implemented. Your only option if you don't like the modifications is to stop using the service.

Your duties are as follows:

Members must use their phone number or email to confirm their identity. We don't check up on Members' histories, reputations, or other publicly available information. When communicating with other Members, it is your job to use common sense and assess their appropriateness. Potential drivers and passengers should be approached directly, and you should exercise the same care you would when meeting someone for the first time.
You alone are accountable for how you communicate with other Members. In the event of such contacts, GoMyway Canada shall not be held responsible for any injury or damage. We retain the right to keep an eye on conversations and block members who publish inappropriate content.

Release:

GoMyWay Canada will act as a facilitator and not become involved in any Member issues. You waive any claims, demands, and damages against GoMyWay Canada and its affiliates by using the Service.
Your Conduct: As a Member of the Service, you are expected to behave properly and wisely. Included in this are, but are not limited to:

  • Exercising caution and responsibility when driving, abiding by traffic laws, and making sure the automobile is in excellent functioning order.
    Respecting the legal, contractual, and other rights of others, such as their intellectual property and privacy.
    Relying only on the Service's information for authorised uses.
    Not disrupting or destroying the Service.
    Refraining from spamming.
    Treating other Members with respect and abstaining from bullying or stalking them on the Service.
    Using the Service for commercial purposes without GoMyWay Canada prior consent.
    Not signing up for the Service on someone else's behalf.
    Having reached the age of majority (18) and being of sound mind.

  • Bringing Up Misconduct:

    You must notify GoMyWay Canada and the appropriate authorities if you think another Member has acted improperly. Your report, however, does not compel us to act or expose us to any liability.
    Your use of the platform operated by GoMyWay Canada is subject to these Terms of Service. Before using the Service again, be sure you comprehend and agree to all of the conditions.
    Use and Access of the Service Unless otherwise authorized through a written agreement with the firm, no commercial activities are allowed on the GoMyWay Canada platform.

    Ridesharing Not for Profit:

    Only non-commercial ride sharing between drivers and passengers is the Service's sole purpose. Any use of the Service for commercial or profit-making endeavours is strictly forbidden absent the written agreement of GoMyWay Canada.
    Non-Profit Travel: Drivers cannot make any money from any travel. The primary purpose of the Service and the trip donation is to pay the driver's expenses; no profit-making is permitted. No trip contributions, trip kinds, frequency, or passenger capacity-based revenues are permitted for drivers. This applies to all activities and extra services that drivers and passengers have agreed upon.
    All journeys, including pick-up and drop-off sites, must be pre-arranged with the Service in advance. Passengers may not be picked up by drivers from places that have not been pre-planned using the Service.

    Speculative Journeys

    Drivers are not permitted to submit speculative excursions. Trips may only be listed if the driver is confident in the itinerary and will leave at the scheduled time, whether or not reservations have been made.

    Insurance Responsibility

    The service may NOT be used in a manner that renders a driver's insurance coverage worthless. GoMyWay Canada limits its liability in accordance with the Terms of Service and disclaims liability for any member's violation of these Terms of Service or breach of an agreement between members, including when a driver renders services in a manner that could render their insurance invalid.

    Not an agent or contract party:

    GoMyWay Canada serves as a forum for contact between members; it does not offer transport services. Trips, locations, or timings are not handled by the Service. The only parties to the ridesharing contract are the driver and the passenger. GoMyWay Canada does not represent any member and is not a party to any agreement or transaction between members.

    Effects of a Breach:

    Any violation of these terms of service will result in the immediate suspension of your account and could prevent you from using the Service in the future.

    GoMyWay Canada accessibility:

    Account Creation: Each member must register for a GoMyWay Canada account in order to use the ridesharing service. You must log in or register with your email and password, fill out all necessary areas, validate your email address and phone number, and give accurate personal information in order to create an account.

    Account Use and Ownership:

    You consent to keeping your account private and not granting anyone else access to it. You alone, and not another person or on behalf of another person, must take all actions, communicate with other users, make all reservations, and utilize all features available through the Service.

    Security and Confidentiality:

    You are in charge of protecting the secrecy of your login information and are required to alert GoMyWay Canada right once of any unauthorized use or security breach.

    Eligibility:

    GoMyWay Canada has the last say on who is eligible to utilize the service, and it maintains the right to stop providing it to any member at any moment.
    Conditions of Service Provision at GoMyWay Canada Discretion: GoMyWay Canada has the right to discontinue, limit, or modify the Service as it sees fit.

    Consistencies of the Service

    Trips:

    When a driver offers a trip, they must include the origin, destination, date, time, number of seats available, and any other pertinent information. Drivers can be contacted by passengers to make reservations for seats.
    Communication between members is made possible through a messaging service offered by GoMyWay Canada. While private communications are just between the driver and the passenger, public messages are seen by all users.

    Bookings :

    Travelers can reserve tickets using an online credit card. Depending on the system selected, drivers can choose to manually approve or automatically accept reservations.

    Currency and Payments:

    Stripe's secure online payment solution is used to handle all payments in Canadian Dollars (USD).

    Booking Fee:

    On each reservation made through the platform, GoMyWay Canada charges a booking fee. During the booking procedure, the cost is added to the trip contribution and paid by the passenger.

    Interests :

    If payments or contributions made through the Service's booking service are not made on time, interest may eventually accumulate. Members agree not to claim any interest that has accumulated on any unpaid amounts, unless in rare circumstances.

    Identity theft and fraud

    Members consent to work with "GoMyWay Canada," banks, or other governmental or non-governmental organizations to stop fraud and money laundering. This includes making available legitimate identification upon request. If such demands are complied with, the Service may allow access to the Service and/or freeze due money for trips or reservations made via the Service.

    To be paid to the driver

    Drivers must supply their banking information, including their car plate number reference code, for payment processing. A bank account is the only supported payout method for making payouts to drivers on "GoMyWay Canada." Only Canadian bank accounts in USD are processed for bank account disbursements. Payments issued to improper bank accounts cannot be reversed, and "GoMyWay Canada" disclaims responsibility for inaccurate bank account information given by drivers. For security reasons and to stop fraud, further verifications—including identification verification—might be needed.

    Payment Procedure

    The passenger's money passes through a 24-hour clearance process after the trip. The payment is cleared the next day after this time has ended, and there are no issues. The driver can then get the contribution share of the amount as a Payout after deducting the booking charge. For the Payout to be executed, the driver's "GoMyWay Canada" account must have a working Payout Method configured. Drivers receive payouts once a day. The Payout is forfeited, and the money belongs to "GoMyWay Canada" if a legitimate Payout Method isn't recorded within four weeks of the trip's completion.

    Conditions for Payment to the Driver:

  • In the course of a trip with passengers, the driver is required to:

    1. Five (5) minutes before the pick-up time, arrive at the location.
    2. Before leaving, let authorised passengers know of any changes to the itinerary.
    3. Up to 10 minutes after the scheduled pick-up time, wait for passengers and phone those that have not arrived before departing.
    4. Drive people safely to the specified destination.
    5. Not without "GoMyWay Canada's express consent, run a for-profit, commercial business.
    6. If these requirements are not met, "GoMyWay Canada" retains the right to issue a refund to a passenger and/or to terminate the driver's account.

  • Policies on Disputes, No Shows, and Cancellations:

    Policy for Driver Cancellations

  • • Without incurring any fees, a driver may cancel a journey at any moment with or without permitted passengers.
  • • The "cancellation allowance" is one trip with authorized bookings or one approved booking every six-month period, after which a driver's account may be reviewed or blocked.
  • • For permitted cancellations, refunds to passengers are processed, and "GoMyWay Canada" has the right to suspend a driver's account if they have had a bad cancellation experience.
  • No-Show Policy for Drivers

  • • Driver no-shows may result in immediate account cancellation.
  • • If the driver is determined to be at fault, sanctions may be imposed after verification of the no-show.
  • Cancellation Policy for Passengers

  • • Booking cancellations are not permitted after they have been made prior to the departure time of the tour.
  • Refunds for passengers are based on when the cancellation occurs.

    Policy on no-show passengers

  • • "GoMyWay Canada" retains the right to take action against such bad experiences, including account blocking in the case of a no-show passenger.
  • • Contesting Bookings, Cancellations, or Payments
  • • On the Service, a booking, cancellation, or payment that has an impact on the driver's payment may be contested by both drivers and passengers up to four (4) hours after the scheduled departure of the trip. The payment to the driver will proceed as usual, in accordance with the established norms, if no issues are brought up within this time limit and the passenger confirms that the journey was successfully completed via the Service or other communication channels.
  • • Using the service's review mechanism, disputes may be brought up within the four-hour dispute timeframe. No reimbursements for drivers or passengers will be handled beyond this time period.
  • • Coverage
  • • Drivers oversee insuring their cars in accordance with the applicable regulations and are required to confirm the legitimacy of their insurance prior to each journey. Additionally, a valid driver's license is necessary. The verification of driver's insurance is not the responsibility of "GoMyWay Canada".
  • • In Canada, passengers who contribute to the expense of a trip are often covered by insurance coverage. While ridesharing, both drivers and passengers are accountable for making sure they are covered by insurance.
  • • When using company-issued cars, drivers must make sure that all passengers are covered by insurance. Drivers and passengers are advised that, as explained in Section 3.1, their insurance carriers may decline to pay for losses incurred during the use of a private vehicle for business purposes.
  • • Members agree to assume full financial responsibility for any insurance claims that may not be paid, and "GoMyWay Canada" disclaims all responsibility in such circumstances. If a member engages in any service-related commercial activity, as defined in Section 3.1, the firm reserves the right to suspend the member's account, withhold unpaid amounts, and report unlawful action to appropriate authorities.
  • Conflicts and Litigations

  • • "GoMyWay Canada" offers a contact form so that users may report disputes and settle legal disputes with reservations and cancellations. While the firm strives to respond to all requests quickly, it is not required to settle all disputes that may arise between users of the Service.
  • • "GoMyWay Canada" has the right to detain any unpaid fares until an amicable resolution is reached or a court order is issued if a driver and passenger disagreement cannot be resolved.
  • Verification

  • • The "GoMyWay Canada" platform offers verification. The business has the right to modify, restrict, or end the verification program at any time.
  • Security

  • • "GoMyWay Canada" places a high priority on protecting the information of its members. Secure socket layer (SSL) technology is used to encrypt sensitive data, such as identification papers. The business complies with industry requirements to safeguard personal data while it is being sent and stored. However, no electronic storage or communication technique can provide 100% security. In the event of a breach, "GoMyWay Canada" must quickly provide all disclosures required by law.
  • Responsibilities you have

  • • Members must link their email address, at least one social media account, their mobile phone number, and a valid form of identification (for travelers, this includes a valid driver's license with a current expiration date, a recent driver's license abstract, a national identity document, or a passport) in order to prove their identity. "GoMyWay Canada" does not look into the reputation, behaviour, morals, or criminal history of its members. In deciding whether other members of the Service are appropriate, members must use common sense.
  • Privacy

  • • None of the information gathered during the verification process will be rented, sold, or shared with other parties. Changes to the verification will be announced by email updates, newsletters, and notices on the Service.
  • Referral Initiative

  • • Promo Codes are given to referred members whenever they complete their first booking through the Referral programm, which enables users to earn Promo Codes by recommending new users to "GoMyWay Canada" There are restrictions on the programm, and there are rules that must be followed.
  • Community Consensus

  • • The Community Agreement, which sets requirements for utilising the Service, will be adhered to by Members.
  • • Policies against discrimination and harassment
  • • "GoMyWay Canada" is dedicated to fostering an environment free from harassment and discrimination. The business has measures in place to deal with cases of sexual, physical, and verbal harassment.
  • Reporting

    "GoMyWay Canada" encourages members to report any instances of discrimination, harassment, or sexual harassment for timely inquiry and appropriate action.

    Legal Obligation

    When using the Service, Members are required to abide by all local, state, federal, and international laws and regulations.

    Service Termination & Discontinuance

    "GoMyWay Canada" has the right to deny any member access to the Service with or without a reason and with or without prior notice. Additionally, the business is free to change or stop offering any part of the service at any moment without having to compensate members.
